A closer look at SC Code of Law: Section 59-65-47

(d) educational records shall be maintained by the parent-teacher and include:

(1) a plan book, diary, or other record indicating subjects taught and activities in which the student and parent-teacher engage;

(2) a portfolio of samples of the student's academic work; and

(3) a semiannual progress report including attendance records and individualized documentation of the student's academic progress in each of the basic instructional areas specified in item (c) above.

Section 59-65-47 Law (d) is the law representing the third option (review law D from the link above). You will notice there is not a similar law listed under section 59-65-45, which is the code representing the second option. You will notice there is a similar law listed under section 59-65-40 Law (4), which is the law representing the first option, or home schooling through your local district.

Simply put, if you home school under the 1st option you, the parent/teacher, are responsible for maintaining your education records. If you home school under SCAIHS, the second option, they will maintain your educational records. If you home school under the 3rd option you are responsible for maintaining your educational records.

There are 3rd option accountability associations willing to provide the additional service of maintaining your educational records for a fee. However, according to the SC State Code of Law: Section 59-65-47 Law (d) the parent/teacher is ultimately responsible for all educational records.

Under the third option the parent/teacher is responsible for maintaining the student's records. Palmetto Independent Educators, a third option association, does not maintain educational records.

Will PIE maintain educational records as a service in the future? This will depend on the needs of PIE's members. We feel this is an unnecessary step due to the fact the parent/teacher will need to produce the educational records for PIE to maintain. If we find PIE members are searching for this service, we will consider providing for them. We do provide limited support through the Member Center.

Under the third option, home schools are required by law, and have the right to maintain their own educational records. They have the right to produce their own transcripts, diplomas and report cards. Are these documents important? Yes, it is important for the parent/teacher to maintain accurate records of the student's completed work and activities. Upon completion of high school, the transcripts will play an important part in your child's entrance into college.
